1. Acceptance and eligibility
By creating an account, joining the waitlist, or using the Orbitaly app, you agree to these terms. If you do not agree, do not use Orbitaly. You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to book a flight or hold a subscription through Orbitaly. 2. Your account
Orbitaly uses passwordless, magic-link sign-in: we email you a one-time link, and that link is your credential for that sign-in. Keep access to your email secure, because anyone who can open a magic-link email can sign in as you. You are responsible for all activity under your account. Tell us immediately at [email protected] if you believe your account has been accessed without your permission.
3. Booking flights
Orbitaly books flights through Duffel, a third-party booking platform that connects to airlines directly and through consolidators. Here is exactly how a booking works, so there are no surprises:
- Search shows an indicative fare. The price you see while browsing is not locked. Fares change with availability, sometimes within minutes.
- The fare is re-checked at the moment of payment. Orbitaly re-prices the offer immediately before you pay. If the fare has changed, we show you the new price before you confirm, and you decide whether to proceed.
- There are no fare holds. Orbitaly does not offer a "hold this price" option. A fare is only secured once payment is completed.
- Payment goes directly to Duffel's hosted payment component. Orbitaly's own servers never receive or store your full card number.
- Servicing depends on the fare rules the airline set, not on Orbitaly. Whether a ticket can be changed, cancelled, or refunded, and what that costs, is governed by the fare you purchased. Momo and our support team will always tell you what a specific fare allows before you act on it. See the Refunds & Cancellations page for the full policy.
You are responsible for confirming your own eligibility to travel (passport validity, visas, health and entry requirements) for any trip you book. Orbitaly is not a party to your contract of carriage with the airline; the airline's own conditions of carriage also apply to your ticket.
4. Momo
Momo is an AI concierge. It can answer questions and, for trips booked through Orbitaly, take actions a fare allows (changes, cancellations, refund requests). Momo's answers are generated by a language model and, like any AI system, can be wrong. Confirm anything time-sensitive or high-stakes (gate changes, visa requirements, ticket rules) against the flight's dossier or the airline directly before relying on it. Momo is not a substitute for professional legal, medical, or immigration advice.
5. Subscriptions and purchases
Orbitaly offers a free tier and two paid tiers, sold as auto-renewable in-app subscriptions or a one-time purchase through Apple's App Store:
A subscription automatically renews for the same length and price unless you cancel at least 24 hours before the current period ends. Your Apple ID account is charged for renewal within that 24-hour window. Manage or cancel a subscription any time in your device Settings, under your Apple ID, then Subscriptions; cancelling stops future renewals but does not refund the current period. All purchases are billed and processed by Apple under Apple's own Media Services Terms; refund requests for App Store purchases are handled by Apple, not Orbitaly (see Refunds & Cancellations).
A one-trip pass, group-pay add-ons, and any credit-back or referral offer described in the app are subject to the specific terms shown at the time of purchase or redemption.
6. Acceptable use
Do not use Orbitaly to: book a ticket you do not intend to use for its stated fare basis (fraudulent skiplagging or duplicate/fictitious bookings); attempt to access another user's account or booking; scrape, reverse-engineer, or resell data from the app; interfere with the app's operation or security; or use Momo to generate content that is illegal, abusive, or infringing. We may suspend or terminate access for a violation of this section.
7. Ownership
Orbitaly, the Orbitaly name and mark, the living-atlas globe, and the app's design are owned by [PLACEHOLDER: legal entity name]. You keep ownership of the trip data you add. By using Orbitaly you grant us a license to use that data solely to operate and improve the service for you, as described in the Privacy Policy.
8. Third-party services
Orbitaly relies on third-party providers, including Duffel (booking), Anthropic (Momo's language model), Supabase (backend and authentication), PostHog (analytics), and Apple (distribution and payments). Your use of Orbitaly is also subject to those providers' own terms where they apply directly to you, such as an airline's conditions of carriage or Apple's Media Services Terms. Orbitaly is not responsible for the acts or omissions of an airline or other independent third party.
9. Disclaimers
Orbitaly is provided "as is" and "as available." We do not guarantee that flight status data, Momo's answers, or fare availability will be complete, accurate, or uninterrupted at every moment; live flight positions and delay predictions are estimates drawn from third-party sources and can be wrong. To the extent permitted by law, Orbitaly disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
To the extent permitted by law, Orbitaly and its operator are not liable for indirect, incidental, special, or consequential damages arising from your use of the app, including a missed flight, a fare change, or an airline's own action or inaction. 11. Termination
You may stop using Orbitaly and delete your account at any time. We may suspend or terminate your access if you violate these terms, or to protect the security or integrity of the service. Sections that by their nature should survive termination (ownership, disclaimers, limitation of liability) continue to apply after your account is closed.
12. Governing law and disputes
